1. About these Terms
These Terms of Service ("Terms") are provided by Europe's Best Brands Tattoo Supply, doing business as Magic Moon Tattoo Supply USA ("we," "us," "our"). They govern all purchases made through magic-moon-usa.com (the "Site"). Your use of the Site itself is also subject to our Terms of Use. By placing an order, you agree to these Terms. These Terms require individual arbitration of disputes instead of jury trials or class actions (see Section 10).

You may not order from us if you do not agree to these Terms, are under 18 years old, or are prohibited by applicable law from purchasing our products.

2. Professional use
Our products are intended for use by professional tattoo artists. By placing an order, you confirm that you work in a professional capacity and comply with all applicable local, state and federal requirements. We are not liable for issues arising from improper or unprofessional use.

3. Orders
Your order is an offer to purchase. You will receive an order confirmation email; the contract is formed once we confirm your order. We may refuse or cancel orders at our discretion, for example in case of suspected fraud, pricing errors or unavailable stock. If we cancel an order you have already paid for, we will issue a full refund.

4. Prices and payment

  • Prices are shown in U.S. dollars and may change without notice. The price shown at the time of your order applies.
  • Sales tax and shipping costs are calculated at checkout and shown before you pay.
  • Payment is due at the time of order.
  • Wholesale customers must provide a valid resale certificate to be exempt from sales tax.

5. Shipping and delivery
We ship within the United States via UPS. Shipping costs, processing times and delivery details are described in our Shipping Policy. Title and risk of loss pass to you when we hand the package to the carrier. Delivery times are estimates and not guaranteed.

6. Returns and refunds
Returns, refunds and exchanges are governed by our Refund Policy.

7. Limited warranty

  • Magic Moon products: We warrant that hardware products sold under the Magic Moon brand are free from defects in materials and workmanship for one year from the delivery date.
  • Third-party brands: Products from other manufacturers are covered by the respective manufacturer's warranty. We will assist you with warranty claims.

The warranty applies only to the original purchaser and does not cover damage from improper use, failure to follow instructions or maintenance requirements, modifications, unauthorized repairs, normal wear and tear, accidents or external causes. Repairs or replacements do not extend the warranty period.

If a product is defective under this warranty, we will repair, replace or refund it at our discretion and cover the return shipping. To make a warranty claim, contact us at order@magic-moon-usa.com or +1 833-894-9799 with your proof of purchase. We respond within 1 business day.

Implied warranties, including merchantability and fitness for a particular purpose, are limited to the duration of this warranty. Some states do not allow such limitations, so they may not apply to you. This warranty gives you specific legal rights, and you may have other rights that vary by state.

8. Limitation of liability
To the extent permitted by law, our liability for any product is limited to its purchase price. We are not liable for indirect, incidental, special or consequential damages. Some states do not allow these exclusions, so they may not apply to you.

9. Intellectual property
All trademarks, product names, logos and designs remain the property of us or their respective owners. Purchasing a product does not grant you any intellectual property rights.

10. Dispute resolution and arbitration
Any dispute arising from these Terms or your purchase will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or Commercial Arbitration Rules for business customers). The Federal Arbitration Act governs this section. You and we waive the right to a jury trial and to participate in a class action. Either party may bring an individual claim in small claims court if it qualifies.

11. Governing law
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules.

12. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control, such as natural disasters, government actions, carrier delays or power outages.

13. Changes and entire agreement
We may update these Terms at any time; the version posted on the Site at the time of your order applies. These Terms, together with our Refund Policy, Shipping Policy, Privacy Policy and Terms of Use, form the entire agreement between you and us. If any provision is held invalid, the remaining provisions remain in effect.
